Abstract

The creation and development of the pilot free trade zone （hereinafter the “FTZ”）is another major the oretical and practical innovation since the Reform and Opening-Up.This innovation no longer creates policy vacuum but establishment of a comprehensive experimental field for continuous reform and innovation，as well as the core mission of pioneering and exploring the modernization of national governance system.Its significance is very far-reaching.Since the creation and operation of the first Shanghai FTZ in the country，in just five years，subversive momentum of changes have been generated in various fields，such as administrative management，legal practice，and economic functioning.However，break-throughs in the system of administrative management have also brought forth many new issues in the practice of the rule of law.Therefore，the construction and development of FTZs，concerning the government ruled by law，has become a research hotspot with great theoretical and practical value.

This book starts with the development of the government ruled by law in China's FTZ，specially focuses on the achievements and issues of Guangdong FTZ.Then the book discusses the obstacles encountered in the FTZ concerning the government ruled by law as well as the possible solutions.Different from foreign FTZs，China's FTZs involve not only reform in economic field but also reform in the government.It is this two-tiered responsibility that has made the development of FTZ more difficult，especially the case of Guangdong FTZ which contains three different regions.The separation of power between the local and the central government，and the coordination between different administrative powers are especially difficult.For the foreign FTZs，apart from its different forms，they do provide a wide range of innovation measures.Therefore，to promote the development and perfection of the Guangdong FTZ within the government ruled by law，we should implement the principle of rule of law and promote the reform of the administrative system and mechanism of the Guangdong FTZ.Furthermore，we should reduce the intervention of government within FTZ，separate local and central power boundaries，authorize certain autonomy to the governing institutions of the FTZ.At the same time，the further deepening reform and opening-up would force the the government reform on its functioning mechanisms of the Guangdong FTZ.Furthermore，upon the practice of the integration of law enforcement departments currently in the Guangdong FTZ，we could weaken the vertical restraints of various departments，and strengthen the horizontal connections between different departments，enhance the ability of the FTZ governing institutions to respond to changing circumstances to make for a more comprehensive supervision，to promote the innovation and the rule of law in the FTZ.
